The Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 mandates the rules and regulations, privacy policy and Terms and Conditions for access or usage of www.aabadevelopers.com website publishing.
The terms and conditions published herein is an electronic record and is generated by a computer system and does not require any physical signatures.
The domain name www.aabadevelopers.com (hereinafter referred to as "aabadevelopers.com") is owned by Mr. Dev, a sole proprietor.

Purchaser’s Account and Registration Obligations

Platform for Transaction and Communication: The aabadevelopers.com is a platform that Purchasers utilize to discover AABA DEVELOPERS products and to show interest in purchasing these products.

All commercial/contractual terms are offered by and agreed to between the purchasers and AABA DEVELOPERS. The commercial/contractual terms include without limitation, price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products and services and after sales services related to products and services.

Charges
Membership on the aabadevelopers.com is free for purchasers. AABA DEVELOPERS does not charge any fee for browsing and buying on the aabadevelopers.com. AABA DEVELOPERS reserves the right to change its Fee Policy from time to time. The purchasers shall not upload, publish, host, display, modify, transmit, update or share any details, particulars, facts, figures, statistics, data, material, documentation or documents which:​ belongs to another person and to which The purchasers does not have any right to; is directly or indirectly harassing, obscene, pornographic, blasphemous, defamatory, invasive of another's privacy, racially or/and ethnically objectionable, relating money laundering, or otherwise unlawful in any manner whatever; or unlawfully harassing including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986; threatens in any way to defame or/and harm AABA DEVELOPERS; is patently offensive to the online/offline community, such as sexually explicit content, or content promoting obscene, pornographic, blasphemous, racist or/and defamatory materials or physical/mental harm of any kind against any community, group or individual person; involves the transmission of "spamming" or unsolicited mass mailing. infringes upon or violates any third party's rights [including, but not limited to, intellectual property rights, privacy rights (including without limitation unauthorized disclosure of a person's name, email, physical address or contact mobile/phone number), third party’s copyrighted work or publicity rights ]; promotes an unauthorized copy of third party’s or another person’s copyrighted work ( for instructions on complaining about uploaded copyrighted subjects/items/products or substance see "Copyright complaint" below), such as providing pirated computer programs/ pirated digital products including but not limited to Music/ video files or providing information to bypass manufacture-installed copy-protect devices. AABA DEVELOPERS reserves the right to bar any such activity; contains hidden, restricted or password-only access pages or images; provides instructional, productional, promotional information about illegal or prohibited activities such as making or buying illegal weapons; tries to gain unauthorized access or exceeds the scope of authorized access to the aabadevelopers.com or to profiles, blogs, communities, account information, or other areas of the aabadevelopers.com or solicits passwords or personal identifying information for commercial or unlawful purposes from other Purchasers. AABA DEVELOPERS reserves the right to bar any such activity; engages in direct or indirect, offer, attempt to offer, trade or attempt to trade in commercial activities and/or sales without AABA DEVELOPERS’s prior written consent such as contest, barter, advertisement and network marketing/pyramid schemes, or the buying or selling of products related to the aabadevelopers.com.
Throughout this Terms and Conditions, AABA DEVELOPERS's prior written consent means a communication coming from AABA DEVELOPERS's Legal Department, specifically in response to Purchaser’s request, and specifically addressing the activity or conduct for which The purchasers seek authorization; interferes with another Purchaser's use and enjoyment of the aabadevelopers.com or any other individual's Purchaser and enjoyment of similar services; refers to any website or link or URL that, in AABA DEVELOPERS’s sole discretion, contains material that is inappropriate for the aabadevelopers.com or any other aabadevelopers.com, contains content that would be prohibited or violates the letter or spirit of these
Terms and Conditions; harm minors in any way; infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent; violates any law for the time being in force; deceives or misleads the addressee/ Purchasers about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; impersonate another person; contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, Ransomware ,worms, time bombs, cancel bots, email-based worm, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information; threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation; shall not be false, inaccurate or misleading; shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force; shall not create liability for AABA DEVELOPERS or cause AABA DEVELOPERS to lose (in whole or in part) the services of AABA DEVELOPERS’s internet service provider ("ISPs") or other suppliers;
The purchasers shall not use any automatic device including but not limited to "deep-link", "page-scrape", "robot", "spider", or other, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the aabadevelopers.com or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the aabadevelopers.com or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the aabadevelopers.com. AABA DEVELOPERS reserves the right to prevent, restrict or stop any such activity.
The purchasers shall not attempt to gain unauthorized access or exceeds the scope of authorized access to any portion or service of the aabadevelopers.com, or any other systems connected to the aabadevelopers.com including but not limited to any server, computer, or to any of the services offered on or through the aabadevelopers.com, by hacking or any other illegitimate means.
The purchasers shall not probe or test the vulnerability of the aabadevelopers.com or any server, computer, network or to any of the services connected to the aabadevelopers.com nor breach the security or identity or profile authentication arrangements on the aabadevelopers.com or any other connected network to the aabadevelopers.com. The purchasers shall not trace any information about any other Purchaser of or customer or visitor to aabadevelopers.com, or any other customer, including any profile account on the aabadevelopers.com not owned by The purchasers , to its source, or exploit the aabadevelopers.com or any service, product or information made available or offered or linked by or through the aabadevelopers.com, in any way where the purpose is to disclose and/or reveal any data and/or information, including but not limited to personal identification data or information, other than Purchaser’s own information data, as given for by the aabadevelopers.com.
The purchasers shall not make defamatory statement(s) or comment(s) about AABA DEVELOPERS or the brand name or the domain name used by AABA DEVELOPERS including but not limited to the terms “AABA DEVELOPERS”, “aabadevelopers.com”, or otherwise engage in any conduct or activity that might taint or defame the image or reputation of AABA DEVELOPERS on platform or otherwise taint or dilute any AABA DEVELOPERS's trade or service marks, trade name and/or reputation connected with such trade or service marks, trade name as may be owned or used by the AABA DEVELOPERS. The purchasers agree that they will not take any conduct, activity or action that imposes an unwarranted unreasonable or disproportionately large load on the infrastructure, networks, and/or systems of the aabadevelopers.com or any systems, arrangements or networks connected to AABA DEVELOPERS.
The purchasers agree not to use any device, machine, tool, software, computer program or activity to interfere or attempt to interfere with the proper activity and functioning of the aabadevelopers.com or any transaction being done on the aabadevelopers.com, or with any other individual’s use of the aabadevelopers.com.
The purchasers may not forge or manipulate headers or otherwise forge or manipulate identifiers in order to disguise and misrepresent the origin of any message or transmission of such message The purchasers send to AABA DEVELOPERS, on or through the aabadevelopers.com or any service offered on or through the aabadevelopers.com. The purchasers shall not pretend that they are, or that they represent, someone else, or impersonate any other person or entity.
The purchasers shall not use the aabadevelopers.com or any material for any purpose that is unlawful, invalid, restricted or prohibited by these Terms and Conditions, or to promote the performance of any illegal activity or other activity which infringes the rights of AABA DEVELOPERS and / or others.
The purchasers shall ensure at all times, the full compliance with the provisions of the Information Technology Act, 2000 as applicable and the applicable rules and regulations thereunder and as amended from time to time and also all the Domestic laws, Statutes, Ordinances and regulations (including any applicable Exchange Control laws, rules and regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Service Tax, Central Excise, Custom Duty, Local Levies) applicable regarding Purchaser’s use of AABA DEVELOPERS’s service and Purchaser’s listing, purchase, solicitation of offers to purchase, and sale of products or services. The purchasers shall not engage in any transaction in a product or service, which is prohibited by any applicable laws, Statutes, Ordinances and regulations for the time being in force.
To enable AABA DEVELOPERS to Solely use the information supplied by The purchasers to AABA DEVELOPERS, so that AABA DEVELOPERS is not infringe any rights The purchasers might have in Purchaser’s Information, The purchasers agree to provide AABA DEVELOPERS an irrevocable, non-exclusive, perpetual, sub-licensable (through multiple tiers) worldwide, royalty-free right to exercise the copyright, database rights, publicity, or any other rights The purchasers have in Purchaser’s Information, in any media now known or not currently known, with respect to Purchaser’s Information. AABA DEVELOPERS will only use Purchaser’s information in accordance with the Terms and Conditions and Privacy Policy applicable to use of the aabadevelopers.com.
The purchasers shall be responsible to up keeping the providing data and information relating to the products proposed to be sold by AABA DEVELOPERS. In this connection, The purchasers undertake that all such data and information shall be secured and protected in all the respects. The purchasers completely understand that AABA DEVELOPERS have the right to disclose any information (including the identity of the persons providing information or materials on the aabadevelopers.com),at all times, as necessary to satisfy any law, regulation or valid governmental request. This may include, without limitation, the information disclosure in connection with investigation of alleged illegal activity or solicitation of illegal activity or in response to a lawful court order, writ or subpoena. AABA DEVELOPERS shall have the right, in AABA DEVELOPERS’s sole discretion, to remove or edit any material that violates, or is alleged to violate, any applicable provisions of laws or either the spirit or letter of these Terms and Conditions. AABA DEVELOPERS shall have all the rights in its sole discretion, to take necessary action and claim damages that may occur due to Purchaser’s involvement/participation in any way on Purchaser’s own or through group/s of people, intentionally or unintentionally in DoS/DDoS (Distributed Denial of Services).
Unless such right is expressly granted to the purchaser in writing by AABA DEVELOPERS, the purchasers shall not have the right to resell any of the products purchased from aabadevelopers.com.
AABA DEVELOPERS reserves the right to restrict the sale of goods and/or services.
Contents Posted on aabadevelopers.com
In relation to the products and services offered on the aabadevelopers.com, the text, graphics, Purchaser interfaces, visual interfaces, photographs, trademarks, logos, sounds, music and artwork (collectively, "Content"), is AABA DEVELOPERS generated content.
Without AABA DEVELOPERS's express prior written consent and except as expressly provided in these Terms and Conditions, no part of the aabadevelopers.com and no Content may be republished, copied, encoded, reproduced, translated, transmitted, uploaded, posted, publicly displayed, or distributed in any way (including "mirroring") to any other website, server, computer, or other medium for publication or distribution or for any commercial usage.

The purchasers shall be responsible for any profiles, notes, images, videos, audio files, messages, photos, drawings, emails, billboard postings, opinions, ideas, or other materials or information posted or transmitted to the aabadevelopers.com (collectively, "Content"). Such Content will become AABA DEVELOPERS’s property and The purchasers grant AABA DEVELOPERS the worldwide, perpetual and transferable rights in such Content. Protection of Purchaser’s privacy is a very important principle in the AABA DEVELOPERS vision. The purchasers and Purchaser’s Personal Information is one of AABA DEVELOPERS’s most important assets which AABA DEVELOPERS clearly understands. AABA DEVELOPERS stores and process Purchaser’s Information including any sensitive financial information collected (as defined under the Information Technology Act, 2000), if any, on computers that may be protected by physical as well as reasonable technological security measures and procedures in accordance with Information Technology Act 2000 and Rules there under. Payment Facility for Purchasers

The purchasers may agree with AABA DEVELOPERS through electronic communication platforms and electronic records and using the automated features as may be provided by Payment Facility on any extension or increase in the Dispatch and/or Delivery time and the Transaction shall stand amended to such extent. Any such extension or increase of Dispatch and/or Delivery time or subsequent novation or variation of the Transaction should be in compliance with Payment Facility Rules and Policies.

The purchasers shall electronically notify Payment Facility using the appropriate aabadevelopers.com features immediately upon Delivery or non-Delivery within the time period as provided in Policies. AABA DEVELOPERS may do such checks as it deems fit before approving the receipt of/Purchasers commitment to pay (for Cash On Delivery transactions) Transaction Price from the purchaser for security or other reasons at the discretion of AABA DEVELOPERS. As a result of such check if AABA DEVELOPERS is not satisfied with the credibility of the purchaser or genuineness of the Transaction or Transaction Price, it will have the right to reject the receipt of or Purchasers commitment to pay Transaction Price.

AABA DEVELOPERS may delay notifying the payment confirmation i.e. delay to Dispatch, if AABA DEVELOPERS deems suspicious or for Purchasers conducting high transaction volumes to ensure safety of the Transaction and Transaction Price. In addition, AABA DEVELOPERS may hold Transaction Price and AABA DEVELOPERS may not Dispatch or remit Transaction Price to law enforcement officials (instead of refunding the same to Purchaser) at the request of law enforcement officials or in the event the purchaser is engaged in any form of illegal activity.

The purchaser and Seller acknowledge that AABA DEVELOPERS will not be liable for any damages, interests or claims etc. resulting from not processing a Transaction/Transaction Price or any delay in processing a Transaction/Transaction Price which is beyond control of AABA DEVELOPERS.

Compliance with Laws

Purchaser shall comply with all the applicable laws, Statutes, Ordinances and regulations for the time being in force, (including without limitation Foreign Exchange Management Act, 1999 and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by Reserve Bank of India from time to time, Income Tax Act, 1961, Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Customs Act, and the rules made thereunder, Foreign Contribution Regulation Act, 1976 and the rules made there under, Prevention of Money Laundering Act, 2002, and the rules made there under, Export Import Policy of government of India) applicable to them respectively for using Payment Facility and AABA DEVELOPERS aabadevelopers.com.

Purchaser's arrangement with Issuing Bank

All Valid Credit or Debit or Cash Card and/or other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the purchaser and the respective Issuing Bank and payment instrument issuing company.

All Online Bank Transfers from Valid Bank Accounts are processed using the gateway provided by the respective Issuing Bank which support Payment Facility to provide these services to the purchasers . Replacement Policy

Warranty: The purchaser undertakes to take all the necessary measures to preserve in good condition all the products ordered.

Profanity Policy

d) Spam (Unsolicited junk or chain emails or Commercial email) - AABA DEVELOPERS's spam policy applies only to unsolicited commercial messages sent by AABA DEVELOPERS Purchasers. AABA DEVELOPERS Purchasers are not allowed to send spam messages to other Purchasers.
e) Offers to Buy or Sell Outside of AABA DEVELOPERS - AABA DEVELOPERS prohibits email offers to buy or sell listed products outside of the AABA DEVELOPERS aabadevelopers.com. Offers of this nature are a potential fraud risk for both Purchasers and AABA DEVELOPERS.
f) AABA DEVELOPERS policy prohibits Purchaser-to-Purchaser threats of physical harm and/or abuse via any method including, phone call, SMS, email and on AABA DEVELOPERS’s public message section,
